The agreement between you and Trenlytics Cloudonomics for using HERE — in plain English.
These Terms and Conditions ("Terms") govern your use of HERE, a private WhatsApp memory assistant offered by Trenlytics Cloudonomics (OPC) Private Limited, a company incorporated under the Companies Act, 2013, having its registered office in Gurugram, Haryana, India ("Trenlytics", "we", "us", "our").
By registering for, subscribing to, or using HERE — including by sending any message to our WhatsApp number, browsing this website, or paying for any tier — you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use HERE.
HERE is a private assistant that runs on WhatsApp. You save our contact and send it what you want to remember. HERE stores that content and answers your questions about it later, in your language. It also schedules reminders you explicitly ask for, and sends you one daily activity summary (which you can turn off).
HERE only messages you. HERE never messages your customers, suppliers, contacts, or any third party on your behalf without an explicit action from you. See our post Why we don't message your customers.
Your HERE account is tied to your WhatsApp phone number. You are responsible for keeping access to that number secure. If your number is transferred to someone else, you must inform us so we can prevent unauthorised access.
You must be at least 18 years old to use HERE. By using it, you represent that you are of legal age.
For business accounts, the person signing up warrants that they have authority to bind the business to these Terms.
The current tiers, features, message limits and prices are set out on the Pricing page. Prices in INR are subject to GST at the applicable rate (currently 18%). USD prices are treated as export of service and are exempt from GST. We may revise prices; you will be notified in advance of any change to a tier you already subscribe to.
Paid subscriptions are billed monthly in advance via Cashfree Payments. Payment is auto-debited on the same date each month using the payment method you registered.
Every INR payment is issued a GST-compliant tax invoice from Trenlytics Cloudonomics (OPC) Private Limited to your registered billing email. Add your business GSTIN to your profile before checkout for input tax credit.
You may cancel at any time by sending CANCEL to HERE. Access continues until the end of the current billing cycle; you are not charged again. For your first monthly subscription, if you cancel within 7 days and are unsatisfied, we will refund it in full, no questions asked. Otherwise, monthly fees already charged are non-refundable.
If a scheduled payment fails, HERE will notify you and continue service for a 5-day grace period. If payment is still not completed, your account will be downgraded to FREEMIUM until it is settled.
You agree to use HERE only for lawful purposes. Specifically, you will not:
The Service — including the HERE name and logos, "IT'S HERE", "ALL'S HERE", "HERE PRO", the Trenlytics name and marks, the website design and code, and our proprietary models and prompts — is owned by Trenlytics Cloudonomics (OPC) Private Limited or licensed to us. You do not acquire any right to any of it except the right to use the Service in accordance with these Terms.
You retain all rights in the Content you send to HERE. You grant us a limited, worldwide, royalty-free licence to store, process and analyse that Content for the sole purpose of operating the Service for you and improving it (subject to the tier-based training exclusions described in the Privacy Policy).
If you send us feedback, feature requests, or bug reports, we may use them without restriction or compensation.
HERE relies on WhatsApp, Google Cloud, Sarvam AI, Cashfree and other processors listed in our Privacy Policy. Their availability affects ours. Your use of WhatsApp is governed by WhatsApp's own terms. We are not responsible for outages or acts of these providers, but we will keep you informed of any material disruption.
We provide the Service "as is" and "as available". While we work hard to keep HERE accurate and reliable, we do not warrant that it will be uninterrupted, error-free, or free of loss. HERE is a memory aid, not an authoritative record of any legal, financial, medical or safety-critical fact — always verify important information from the source.
To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, other than warranties that cannot be excluded under Indian law.
To the maximum extent permitted by law, our aggregate liability to you arising out of or in connection with the Service or these Terms shall not exceed the total amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or ₹5,000, whichever is greater.
Neither party shall be liable to the other for any indirect, incidental, special, consequential or punitive damages, including loss of profits, goodwill, or data.
You agree to indemnify and hold harmless Trenlytics Cloudonomics (OPC) Private Limited from any claim, damage or loss arising from your misuse of the Service, breach of these Terms, or infringement of any third-party right by content you send.
These Terms remain in force while you use HERE. Either party may terminate at any time — you by sending CANCEL to HERE, we by giving you at least 15 days' notice or immediately if you materially breach these Terms or use the Service unlawfully. On termination, your memory is deleted per the retention schedule in the Privacy Policy.
We may suspend the Service to a specific account without prior notice where required to prevent ongoing harm (e.g. abuse, security incident); we will notify you of the reason and offer a path to resolution.
We may update these Terms. Material changes will be notified via a message from HERE and a notice on this page, at least 15 days before they take effect. Continued use after that date constitutes acceptance; if you disagree, cancel your account before the effective date.
These Terms are governed by the laws of India. The courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising from or in connection with these Terms, subject to any statutory consumer forum available to you.
